1. Acceptance of Terms

Welcome to Flipsentry. These Terms of Service ("Terms") govern your access to and use of Flipsentry's mobile application, website, and related services (collectively, the "Service"). By accessing or using our Service, you agree to be bound by these Terms.

If you do not agree to these Terms, you may not access or use the Service. We reserve the right to modify these Terms at any time, and such modifications will be effective immediately upon posting.

2. Description of Service

Flipsentry is a marketplace alert service that monitors Facebook Marketplace and other online marketplaces for listings matching your specified search criteria. Our Service provides:

• Real-time notifications about new marketplace listings
• Custom search filters and preferences
• Listing favorites and organization tools
• Mobile and web access to your saved searches
• Premium features based on your subscription tier

Flipsentry is a third-party service and is not affiliated with, endorsed by, or sponsored by Meta Platforms, Inc. (Facebook) or any other marketplace platform we monitor.

3. Account Registration

To use certain features of the Service, you must register for an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Maintain the security of your password and account
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

You must be at least 13 years old to create an account. If you are under 18, you may only use the Service with the involvement and consent of a parent or legal guardian.

4. Subscription and Payment

4.1 Free Trial

We offer a 7-day free trial for new users. No credit card is required during the trial period. At the end of the trial, your account will revert to a free tier with limited features unless you choose to subscribe to a paid plan.

4.2 Subscription Plans

Flipsentry offers multiple subscription tiers with different features and pricing. By subscribing to a paid plan:

• You authorize us to charge your payment method on a recurring basis
• Subscriptions automatically renew unless cancelled before the renewal date
• Prices are subject to change with 30 days' notice
• You are responsible for all charges incurred under your account

4.3 Cancellation and Refunds

You may cancel your subscription at any time from your account settings. Cancellations take effect at the end of the current billing period. We do not provide refunds for partial subscription periods, except as required by law or at our sole discretion.

5. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree NOT to:

• Use the Service for any illegal or unauthorized purpose
• Violate any laws, regulations, or third-party rights
• Attempt to interfere with or disrupt the Service
• Reverse engineer, decompile, or hack any part of the Service
• Use automated tools (bots, scrapers) to access the Service
• Share your account credentials with others
• Create multiple accounts to circumvent limitations
• Harass, abuse, or harm other users
• Impersonate any person or entity
• Collect or harvest user data without consent
• Use the Service to spam or send unsolicited communications

6. Intellectual Property Rights

The Service and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by Flipsentry and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to access and use the Service for your personal, non-commercial use. This license does not include any resale or commercial use of the Service or its contents.

7. Third-Party Content and Links

The Service displays listings and content from third-party marketplaces, particularly Facebook Marketplace. We do not control, endorse, or assume responsibility for any third-party content. You acknowledge that:

• Flipsentry is not responsible for the accuracy, legality, or appropriateness of third-party listings
• Transactions are between you and the third-party seller
• We are not a party to any transactions facilitated through marketplace platforms
• You should verify listing information before making any purchase
• Third-party websites and services are governed by their own terms and privacy policies

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

Flipsentry does not warrant that:

• The Service will be uninterrupted, timely, secure, or error-free
• The results obtained from using the Service will be accurate or reliable
• All listings will be delivered or that notifications will be instant
• Any errors in the Service will be corrected

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FLIPSENTRY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

• Your access to or use of or inability to access or use the Service
• Any conduct or content of any third party on the Service
• Unauthorized access, use, or alteration of your data
• Missed notifications or delayed alerts
• Transactions or interactions with marketplace sellers

IN NO EVENT SHALL FLIPSENTRY'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE AMOUNT PAID BY YOU TO FLIPSENTRY IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

10. Indemnification

You agree to indemnify, defend, and hold harmless Flipsentry and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorney's fees, arising out of or in any way connected with:

• Your access to or use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Any transactions or interactions with marketplace sellers

11. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including but not limited to:

• Breach of these Terms
• Fraudulent, abusive, or illegal activity
• Extended periods of inactivity
• At our sole discretion

Upon termination, your right to use the Service will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration, except that either party may seek injunctive relief in court for intellectual property disputes.

13. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after revisions become effective, you agree to be bound by the revised terms.

14. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Flipsentry regarding the use of the Service and supersede all prior agreements and understandings, whether written or oral.
